Terms of Service
These terms govern access to the consenteer.com website and use of the Consenteer service, including its SDK, extensions and back office.
This page is a courtesy translation of the French original. In case of any discrepancy, the French version prevails.
1. Publisher
The Consenteer service is published by Haniko, a French simplified joint-stock company (SAS),
registered under SIREN number 851 022 061,
with its registered office at 31 avenue de Ségur, 75007 Paris, France
(hereinafter the “Publisher”).

2. Purpose
Consenteer is a consent management platform (CMP) that makes it possible to display a consent banner on a website, to collect and retain visitors' choices, to block third-party scripts in the absence of consent, and to pass consent signals on to compatible tools, in particular Google Consent Mode v2.
These Terms of Service (hereinafter the “Terms”) define the conditions for accessing and using the service. They apply to anyone using the consenteer.com website, the my.consenteer.com back office, the SDK distributed from cdn.consenteer.com, and the official extensions published by the Publisher, including the WordPress extension.
3. Acceptance
Creating an account, installing the SDK or an official extension, or using the service constitutes full and unreserved acceptance of these Terms. A user acting on behalf of a legal entity declares that they have the necessary authority to bind it.
4. User account
Access to the service requires creating an account on my.consenteer.com. The user undertakes to provide accurate information and to keep it up to date. The user is responsible for the confidentiality of their credentials and for any activity carried out from their account. Any unauthorized use must be reported to the Publisher without delay.
The user may delete their account at any time from the back office or on simple request to the contact address.
5. Plans and billing
The service is offered in several plans, including a free plan, described on the Pricing page. Each plan has usage limits (number of sites, page views per site, consent retention period) specified on that page.
Exceeding a usage limit never results in the banner ceasing to be displayed: the user is informed and invited to change plan.
Prices are stated in euros excluding taxes; the applicable VAT is added at payment. Paid plans are subscribed to online from the back office, by monthly or annual subscription payable in advance by bank card. Payment is processed by the provider Stripe; the Publisher does not retain any bank card data. The subscription is tacitly renewed at each due date, for an identical term, until it is terminated. The Enterprise plan is subject to a quote. Any price change is communicated in advance.
The user may change plan at any time from the back office. Upgrading to a higher plan takes effect immediately; the price difference is invoiced pro rata for the remaining period. Downgrading to a lower plan takes effect at the end of the current period.
The user may cancel their subscription at any time from the back office. Cancellation takes effect at the end of the current period: the plan remains active until that date and amounts already paid are not refunded. The account then switches to the free plan, whose limits then apply, including the consent retention period: data older than that period is deleted, and the user is invited to export it beforehand.
The service is intended for professional use. A user acting in the course of their professional activity does not benefit from the right of withdrawal provided for by the French Consumer Code. Where the user is a consumer, they may exercise their right of withdrawal within fourteen days of subscribing by informing the Publisher via the contact form. However, by requesting immediate activation of the paid plan, they request that the service be performed before the end of this period and, if they withdraw, pay the Publisher an amount proportional to the period already elapsed.
If a payment fails, the user is informed and further attempts are made. Failing settlement, the subscription is terminated and the account switches to the free plan.
6. User obligations
The user undertakes to use the service in accordance with applicable regulations and these Terms. In particular, they shall not:
- use the service for unlawful purposes or for content that infringes the rights of third parties;
- attempt to access the Publisher's systems without authorization, disrupt them or circumvent their usage limits;
- reverse engineer the service or resell access to it without the Publisher's written agreement;
- configure the banner in a way that is contrary to the regulations applicable to consent.
The user remains solely responsible for the content declared in their configuration (categories, purposes, cookie descriptions) and for its accuracy with regard to their own site.
7. Roles of the parties and personal data
Within the framework of the service, the user acts as data controller for the consent data collected on their site. The Publisher acts as processor within the meaning of the GDPR and processes this data on the user's instructions, solely for the purpose of providing the service.
The data is hosted within the European Union. IP addresses are never stored in clear. The service does not transmit any browsing data to third parties for advertising purposes.
The processing of data on the showcase website is described in the privacy policy. A data processing agreement (DPA) may be concluded with the Publisher on request.
8. Availability and changes
The Publisher uses reasonable means to ensure the availability of the service, without guaranteeing the absence of interruptions. Maintenance operations may temporarily suspend access to the back office; the banner already installed continues to operate on the basis of the configuration that has been served.
The service evolves: the Publisher may add, modify or remove features. Features flagged as “soon” are announced for information only and do not constitute a contractual commitment as to timing.
9. Intellectual property
The service, the SDK, the official extensions, the documentation, the brand and the graphic elements are the exclusive property of the Publisher. For the duration of their use of the service, the user benefits from a personal, non-exclusive and non-transferable right of use, limited to operating the service on the sites they declare.
The user's configuration data and consent logs belong to the user and remain exportable from the back office.
10. Liability
Consenteer is a tool designed to help its users comply with consent-related obligations, in particular the GDPR, the “ePrivacy” directive and the recommendations of the CNIL (the French data protection authority). Use of the service does not constitute legal advice and does not, on its own, guarantee the compliance of the user's site, which depends on its configuration and on all the processing the user carries out.
The Publisher cannot be held liable for indirect damages, nor for the consequences of an incorrect configuration, an inaccurate declaration of cookies, a change to the user's site or the unavailability of a third-party service. The Publisher's liability is, in any event, limited to the amounts actually paid by the user over the previous twelve months.
11. Suspension and termination
The user may stop using the service at any time by removing the snippet from their site and deleting their account. Termination of a paid subscription is governed by article 5. The Publisher may suspend or terminate an account in the event of a breach of these Terms, after prior notice to the user except in cases of urgency or manifest illegality. Upon termination, data is deleted in accordance with the applicable retention periods; the user is invited to export it beforehand.
12. Changes to the Terms
The Publisher may amend these Terms to take account of changes to the service or to regulations. The online version prevails. In the event of a substantial change, users with an account are informed.
13. Governing law and jurisdiction
These Terms are governed by French law. Failing an amicable resolution, any dispute falls within the jurisdiction of the courts within the jurisdiction of Paris, subject to the mandatory provisions applicable to consumers.
